PixiePlant Terms of Use

Welcome to PixiePlant. These Terms of Use ("Terms") are a legal agreement between you and PixiePlant ("we", "our", or "us"). By creating an account, downloading the app, or using PixiePlant in any way, you agree to these Terms. If you do not agree, please do not use PixiePlant.

PixiePlant is a mobile app that helps you track houseplants, log care actions, manage schedules, and connect with other plant owners. PixiePlant is currently in open beta — some features are still being built or refined.

Who Can Use PixiePlant

You must be at least 13 years old to use PixiePlant. If you are between 13 and the age of majority in your jurisdiction, you may use PixiePlant only with the involvement of a parent or legal guardian. By using PixiePlant you confirm you meet these requirements.

Your Account

To use most features you need to create an account. You agree to:

• Provide accurate information when you sign up.
• Keep your password and sign-in credentials secure.
• Be responsible for everything that happens under your account.
• Tell us promptly if you believe your account has been accessed by someone else.

You may delete your account at any time from within the app, or by contacting us at joshiwata@gmail.com.

License to Use the App

We grant you a personal, non-transferable, non-exclusive, revocable license to install and use PixiePlant on devices you own or control, for your personal, non-commercial use, subject to these Terms. We retain all rights, title, and interest in PixiePlant itself, including the app, its design, its sprites, and its source code.

Acceptable Use

You agree not to:

• Use PixiePlant for any unlawful purpose or in violation of any applicable law.
• Harass, threaten, bully, or impersonate any person.
• Post or share content that is hateful, sexually explicit, violent, deceptive, or otherwise objectionable.
• Spam other users, send unsolicited messages, or use PixiePlant for advertising or commercial solicitation.
• Attempt to gain unauthorized access to accounts, servers, or data.
• Scrape, crawl, reverse-engineer, decompile, or otherwise misuse the app or our APIs.
• Interfere with or disrupt PixiePlant or its infrastructure.
• Use PixiePlant in any way that could harm minors.

We have zero tolerance for abusive or objectionable content. We may remove content, suspend, or terminate accounts that violate these rules, with or without notice.

Your Content

You own the content you create in PixiePlant — your plants, care logs, photos, notes, comments, and similar entries (your "Content"). By creating Content in the app, you grant PixiePlant a worldwide, royalty-free, non-exclusive license to host, store, reproduce, display, and transmit your Content as needed to operate the service (for example, to sync your plants across devices, show your activity to friends you connect with, and back up your data).

You are solely responsible for your Content and represent that you have the rights necessary to share it. We may remove Content that violates these Terms or applicable law.

Social Features

PixiePlant includes social features such as friends, households, profile pages, comments, and shared plant care. When you use these features:

• Your username, display name, avatar, and selected profile details are visible to users you connect with.
• Plant activity you share (such as care actions or new plants) may appear in the feeds of friends and household members.
• You can block other users, and you can report content or accounts that violate these Terms by emailing joshiwata@gmail.com. We aim to review reports of objectionable content within 24 hours and will remove violating content and eject abusive users as appropriate.

Plant Care Disclaimer

Care suggestions, schedules, watering frequencies, and species information in PixiePlant are provided for informational and entertainment purposes only. We are not professional horticulturists, botanists, or veterinarians. PixiePlant does not guarantee plant health outcomes or that information about a species (including toxicity to pets) is complete or accurate. Always do your own research, especially for plants kept around children or animals.

AI-Generated Content

PixiePlant uses third-party artificial intelligence services (currently Google's Gemini API) to help identify plants from photos and to generate care suggestions. Results from these features can be inaccurate, incomplete, or misleading. Treat them as a starting point, not a definitive answer.

Beta Service

PixiePlant is in active development. Features may change, break, or be removed without notice. While we work hard to keep your data safe, you should not rely on PixiePlant as your sole record of any important information. We recommend keeping your own backups of anything you would be unhappy to lose.

Privacy

Our handling of personal information is described in the PixiePlant Privacy Policy, which is incorporated into these Terms by reference.

Termination

You may stop using PixiePlant at any time and delete your account from within the app or by emailing us. We may suspend or terminate your access to PixiePlant at any time, with or without notice, if we believe you have violated these Terms or if we need to do so to protect PixiePlant, our users, or third parties. Sections of these Terms that by their nature should survive termination (including the disclaimers, limitation of liability, and your Content license to the extent needed for backups and legal compliance) will survive.

Disclaimers

PixiePlant is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that PixiePlant will be uninterrupted, secure, or error-free, that defects will be corrected, or that any information provided through PixiePlant (including plant identification or care advice) is accurate or reliable.

Limitation of Liability

To the maximum extent permitted by law, in no event shall PixiePlant, its developers, contributors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or plants, whether based on contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to these Terms or PixiePlant is limited to the greater of (a) the amount you have paid us in the twelve months preceding the claim, or (b) fifty United States dollars (USD 50).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. In such cases, our liability is limited to the maximum extent permitted by applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless PixiePlant and its developers from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of PixiePlant, your Content, your violation of these Terms, or your violation of any rights of another person or entity.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you in the app. Continued use of PixiePlant after the changes take effect constitutes your acceptance of the updated Terms.

Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or PixiePlant will be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts. Nothing in these Terms prevents either party from seeking relief in small-claims court for qualifying disputes.

Apple App Store Additional Terms

If you downloaded PixiePlant from the Apple App Store, the following additional terms apply. These Terms are between you and PixiePlant only, not with Apple. Apple is not responsible for PixiePlant or its content. Apple has no obligation to provide maintenance or support for PixiePlant. In the event of any failure of PixiePlant to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for PixiePlant; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to PixiePlant. Apple is not responsible for addressing claims by you or any third party relating to PixiePlant, including product liability claims, claims that PixiePlant fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation. Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that PixiePlant or your use of it infringes that party's intellectual property rights. You agree to comply with applicable third-party terms of agreement when using PixiePlant. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
